DashPoint Full Disclaimer & Platform Terms

1. About DashPoint

DashPoint is a digital platform that enables users to discover, access, and participate in events, activities, and experiences listed within the DashPoint application ("the Platform"). DashPoint acts primarily as a technology and discovery platform and, unless explicitly stated otherwise, does not organise, host, operate, or control events listed on the Platform.

2. Event Organisation & Responsibility

Third-Party Events

Unless an event is clearly identified as a DashPoint-organised event, all events listed on the Platform are organised, managed, and delivered by independent third-party event organisers.

For these third-party events:

  • The event organiser is solely responsible for the event, including but not limited to:
    • event planning and delivery
    • participant safety and risk management
    • venue permissions and regulatory compliance
    • cancellations, postponements, and changes
    • refunds and disputes
  • DashPoint does not accept responsibility or liability for the acts, omissions, or conduct of third-party event organisers.
  • Any issues, claims, or disputes relating to a third-party event must be resolved directly with the relevant event organiser.

DashPoint-Organised Events

Where an event is clearly marked as organised by DashPoint, DashPoint will act as the event organiser and any applicable event-specific terms, safety information, and responsibilities will be provided in connection with that event.

3. Event Eligibility & Age Requirements

Unless explicitly stated otherwise, all events listed on the DashPoint Platform are intended for individuals aged 18 and over.

Events that are suitable for participants under the age of 18 will be clearly marked as under-18 appropriate within the event listing.

Where an event is listed as under-18 appropriate:

  • A parent or legal guardian must review and agree to this disclaimer and all applicable terms on behalf of the minor.
  • The parent or legal guardian accepts full responsibility for the minor's participation, including supervision, safety, and compliance with any event-specific requirements.
  • DashPoint does not verify parental or guardian consent and relies on the accuracy of information provided.

By creating an account or participating in an event, you confirm that you meet the applicable age requirements or, where relevant, that valid parental or guardian consent has been obtained.

4. Participation & Assumption of Risk

By attending any event listed on the Platform, you acknowledge that:

  • Many events involve physical activity and may carry inherent risks, including the risk of injury, illness, property damage, or loss.
  • You participate voluntarily and at your own risk.
  • You are responsible for ensuring that you are physically and medically fit to participate.
  • You agree to follow all instructions, rules, and safety guidance provided by the event organiser.

DashPoint does not assess the suitability or safety of third-party events for individual users.

5. Payments, Fees & Refunds

DashPoint may facilitate payments on behalf of event organisers through third-party payment providers.

Unless an event is organised by DashPoint:

  • Refunds, cancellations, and transfer policies are set by the event organiser.
  • DashPoint is not responsible for issuing refunds for third-party events, except where required by law or explicitly stated.
  • Platform or service fees may be non-refundable.

For DashPoint-organised events, applicable payment and refund terms will be provided within the event details.

6. User Conduct

You agree to use the Platform responsibly and not to:

  • misuse or attempt to interfere with the Platform or its services
  • provide false, misleading, or inaccurate information
  • engage in behaviour that is unlawful, unsafe, or harmful to others

DashPoint reserves the right to suspend or terminate accounts that breach these terms.

7. Data Collection & Use

DashPoint collects personal and usage data in order to operate, maintain, and improve the Platform.

This may include:

  • account and profile information
  • event engagement and participation data
  • app usage and interaction data

DashPoint may:

  • share aggregated and/or anonymised data with trusted brand partners, sponsors, and event organisers for analytics, reporting, and insight purposes
  • share relevant user insights with partners where permitted by law and in accordance with the DashPoint Privacy Policy

DashPoint does not sell personal data. All data processing is conducted in compliance with applicable data protection laws, including UK GDPR.

8. Intellectual Property & Content

All intellectual property rights in the Platform, including branding, software, and content, belong to DashPoint or its licensors.

By submitting or uploading content to the Platform, you grant DashPoint a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and promote such content in connection with the operation and marketing of the Platform.

You retain ownership of your content.

9. Limitation of Liability

To the fullest extent permitted by law:

  • DashPoint excludes liability for any loss, injury, damage, or claim arising from attendance at or participation in third-party events.
  • DashPoint is not liable for indirect, incidental, or consequential losses, including loss of income, data, or enjoyment.

Nothing in this disclaimer limits liability where it cannot be excluded under law, including liability for death or personal injury caused by negligence.

10. Indemnity

You agree to indemnify and hold harmless DashPoint from any claims, losses, liabilities, damages, and expenses arising from:

  • your use of the Platform
  • your participation in events
  • your breach of this disclaimer or applicable laws

11. Changes to Events & Platform

DashPoint does not guarantee the accuracy, completeness, or availability of event listings. Event details may change or be withdrawn at any time at the discretion of the event organiser.

DashPoint may modify, suspend, or discontinue any part of the Platform at any time.

12. Governing Law

These terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Acceptance

By creating an account and using the DashPoint Platform, you confirm that you have read, understood, and agree to this disclaimer, the Terms of Service, and the Privacy Policy.
